EB1A I-140 Finally Moved — Result Is an RFE

I asked AI and it said the most likely issue is the Final Merits Determination, followed by insufficient evidence for one or two EB-1A criteria.

I looked it up and found that starting August 2026, USCIS has had cases where the discretion on RFE response deadlines only gives 30 days.

I wanted to ask everyone how the RFE approval rate is right now. I'm feeling anxious and could use some reassurance. Any suggestions for what to do next? I was previously on regular processing.

Do I need to file PP at the same time as the RFE? Thank you everyone, thank you.

It seems like the RFE response can cite evidence already submitted, and you don't need to resubmit all the original materials?

Since this may be a Final Merits Determination, the discussion can focus on how the overall materials form a coherent narrative, rather than just going through the ten criteria one by one. You could first reorganize the evidence already submitted along a logical throughline, and see whether the adjudicator might find the direction insufficiently focused during the final merits analysis.

I'm skeptical about the 30-day response deadline. It's best to go by the date stated in the RFE letter you received; individual cases on forums don't necessarily apply to you.

When it comes to regional differences, the same RFE can actually be handled at a different pace and with different review priorities depending on the service center—and even within the same center, different adjudicators may have their own preferences. So when someone says the approval rate is high or low, that has limited reference value for you. What's more worth examining is which specific criteria the RFE questions and what level of evidence it asks you to supplement.

As for whether to file the PP at the same time, two things need to be confirmed first: the acceptance rules for premium processing after the RFE response is submitted, and whether the premium processing fee is worth spending at this point. If the response deadline itself is already tight, premium processing may end up squeezing your own preparation time, so it may not necessarily be worth it.

Break down each specific point of concern in the RFE one by one before deciding what to supplement—don't rush into redoing the whole thing.

Citing the evidence already submitted is a workable approach, but only if that material is genuinely clear and traceable in the original package and the page numbers and exhibit numbers line up. If the RFE is saying the evidence is not strong enough rather than that material is missing, simply quoting the original text may not be enough to persuade the adjudicator, and you would also need to add external corroboration that reinforces the same point. I suggest first preparing a comparison table that clearly lists each challenge raised, the corresponding location in the original text, and the additional material you plan to submit.

One prerequisite that's easy to overlook: responding to an RFE doesn't end once you've submitted your materials. How you send them, whether they're signed for before the deadline, and whether you keep tracking records all matter a great deal. There are plenty of cases of courier delays when a deadline is approaching, so it's best to build in a few days of buffer.
